Affiliate Agreement :
This agreement contains the terms and conditions that apply to your participation as an Affiliate of Server Package Program ("the Program") of wsnnetpert.com. By submitting your Registration you are confirming that you have read this Agreement and you agree to be bound by the terms and conditions in this Agreement.
- An Affiliate is an individual or organization who is planned to have one or more web sites that can advertise World Server Network services and products through banners, icons and links.
- Registration form submitted will be evaluated and will notify you of our acceptance or rejection in a timely manner. We may reject your application if we determine in our sole and absolute discretion that your site is unsuitable for the Program for any reason.
- We may modify any of the terms and conditions contained in this Agreement, at any time in our sole and absolute discretion. You will be notified by email. Modifications may include, but not limited to, upgrade of server specification, changes in commission scales, other benefits, payment procedures, and program rules. If any modification is unacceptable to you, your only recourse is to terminate this Agreement.
- You and wsnnetpert.com are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this Section.
- You understand and agree that wsnnetpert.com shall have no responsibility or liability for any of the following which do not form part of the Service:
- (a) Collecting any payments due to You from a Client.
- (b) Offers, responses, content or other submissions from other participants in the service.
- (c) Dispute resolution.
- We make no express or implied warranties or representations with respect to the Program or any products sold through the Client Server Program (including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of course of performance, dealing, or trade usage).
- We will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total fees paid under this Agreement.
- You will be solely responsible for the development, operation, and maintenance of your site and for all materials that appear on your site. Such responsibilities include, but are not limited to, the technical operation of your site and all related equipment; creating and posting content, descriptions, and references on your site and linking those descriptions to our catalog; ensuring that materials posted on your site do not violate or infringe upon the rights of any third party and are not libelous or otherwise illegal.
- We disclaim all liability for all such matters. Further, you agree to defend, indemnify and hold us harmless from all claims, damages, and expenses (including, without limitation, attorneys' fees) relating to the development, operation, maintenance or content of your site.
- As you start to develop traffic to your website and responses to your targeted email, you will be bringing along new members. When have found 10, things start to change. You will be selected as an Associate, with additional income and equity opportunity, and more responsibilities. When the time is right you will run your own team and have your own WSN domain server.
- During this process you should familiarize yourself with the background material, training material, and get a feel for how the structure of Iplex works.
Free Webspace Agreement
By submitting of your Registration form for use of Free Webspace program under wsnnetpert.com and netpert.com as our domain server, you are confirming that you have read this Agreement and you agree to be bound by the terms and conditions in this Agreement. wsnnetpert.com and/or netpert.com reserve the right to change these rules at any time with or without notice.
- Each User is allowed to have only one Free Webspace (max. 10MB in principle) and the privileges are given to a netpert and/or wsnnetpert affiliate or member. We will set you up the web pages (up to 10 pages) based on your draft and/or information and idea given by email to build a prosperous online business.
- We will allow for the experienced users only to edit and publish their sites by FTP access.
- The Free Webspace are obliged to place an advertising banners or icons of wsnnetpert.com on your sites.
- Wsnnetpert.com and/or netpert.com reserves the exclusive right to remove any pages from the site at any time with the prior notification of removal. We make no implied or express warranties about the reliability of these pages. We are not responsible for any damage caused by loss of access to, or deletion/alteration of web pages; individual users are responsible for monitoring and creating backups of their pages.
- The following is a non-exclusive list of actions and content that will NOT be permitted for the free webspace users by Hometopia.com :
- Any use of copyrighted material without the express permission of the author or owner.
- Pages that exploit the images of children under 18 years of age.
- Material that is grossly offensive to wsnnetpert and netpert, including material that is threatening, abusive, harassing, defamatory, invasive of private rights, indecent, or otherwise what we would deem as objectionable; including pages that promote illegal activity, and material that defames others.
- Pages that contain material inconsistent with the values of the spirit of the Netpert groups community.
- Use of the Free Web page as storage for remote loading.
- Any software, information, or other material that contains a virus, corrupted data, or any other harmful or damaging component.
- Pages can not contain, or contain links to, any of the following: nudity, sex, pornography, foul language, hate propaganda, anything illegal, mail fraud or pyramid schemes. This includes anything considered adult material.
- You will not send unsolicited email (SPAM) to users, message boards, and/or internet search engines which reference your page.
- Hometopia.com does not permit children under the age of 13 to become members, post home pages on our service. We strongly advise teenagers who do utilize our service not to place any personal information on their sites.
- Users are solely and fully responsible for the content of their pages and may be held legally liable. By submitting or uploading your pages to wsnnetpert.com and/or netpert.com server, you are stating that the pages comply with all Terms of Free Webspace Agreement.
If any third party brings a claim, lawsuit or other proceeding against Hometopia.com based on your conduct while using our services, you agree to compensate us inclusively for any and all expenses incurred by Hometopia.com
in connection with any such claim or lawsuit.
We have no obligation to review pages, and we do not regularly monitor the content of free web pages, yet we reserve the right to investigate any complaints regarding any content of members/affiliates' pages or message postings. In the case of any such complaint, we reserve the right to remove the content and page/site in question.
